Overview of the current status of fire safety laws and regulations in China

Abstract

Fire safety laws and regulations are the key measures used to ensure the healthy economic development and safety of people in the field of fire safety. Understanding the current status of domestic laws and regulations is the proper way to improve emergency response capability and achieve an effective emergency response. China’s fire laws and regulations are a system of laws and regulations, with the Constitution as the core and laws and other normative documents regulating specific matters. At the legal level, by Work Safety Law of the People’s Republic of China and Fire Protection Law of the People’s Republic of China on the principle of fire protection, the basic content, basic form, and main body of responsibility make general provisions, forming a pluralistic main body responsible for the “emerging areas of convergence”, “clear practice-oriented”, and “focus on spiritual factors” are the four major normative principles. Through laws and regulations and a series of normative documents to achieve the prevention of fire, fire rescue, supervision and inspection, and responsibility for the liquidation of the four processes of specific regulations at the policy level to achieve clear authority and responsibility, the field is comprehensive. However, at the level of judicial practice, owing to the complexity of the real situation and the rules of law application, there is still the problem of identifying the subject of fire safety responsibility, which further confirms the need to popularize fire safety laws and regulations.
